This Privacy Policy explains how we handle personal information you provide us on websites owned or controlled by EFX Performance, Inc. ('EFX'), including the websites of any subsidiaries and/or affiliates which link to this Privacy Policy (collectively referred herein to as 'EFX Websites'). This Privacy Policy is not applicable to any personal information which may have been collected from you offline, or to any websites, whether they are owned or controlled by EFX or not, that do not link to this Privacy Policy, or to third-party websites to which the EFX Websites may link.

Your use of an EFX Website indicates your acceptance of and your agreement to comply with this Privacy Policy outlined below and to the Terms of Use. How does this Privacy Policy define "personal information"? 'Personal information' means information that identifies you or could reasonably be used to identify you and which is submitted to and/or collected by EFX Websites and which is maintained by EFX in an accessible form. Examples of personal information include your name, your address and your telephone number. How does EFX collect information online? EFX collects information in two ways:

  • Personal Information You Submit: EFX collects personal information you enter into data fields on EFX Websites. For example, you may submit your name, address, email address, and/or other information in order to receive information about various subjects, register for programs, contact customer service, or respond to surveys. To protect your privacy, you should not provide any information not specifically requested.
  • Passive Collection of Unidentifiable Information: EFX Websites may also collect information about your traffic to and on EFX Websites without your active submission of information. Unidentifiable information may be collected using various technologies, such as cookies, Internet tags, and web beacons. Your Internet browser automatically transmits to EFX Websites some of this unidentifiable information, such as the URL of the website you just visited and the browser version your computer is operating. Passive information collection technologies can make your use of EFX Websites easier by allowing EFX to provide better service, customize sites based on consumer preferences, compile statistics, analyze trends, and otherwise administer and improve EFX Websites. Certain features of EFX Websites may not work without use of passive information collection technologies. In what circumstances might EFX collect and use personal information? EFX may use personal information you provide through EFX Websites to respond to your questions and to provide you with more efficient customer service. After you have entered personal information into a form or data field on an EFX Website, EFX may use certain identifying technologies to allow that EFX Website to 'remember' your personal preferences, such as sections of that EFX Website you visit frequently and, if you choose, your user identification. We may also use personal information for other business purposes, such as to offer you the opportunity to receive notices regarding EFX's products or services, to invite you to participate in surveys about our products, or to notify you about special promotions.

Does EFX consolidate personal information? EFX may consolidate personal information of customers who use EFX Websites. EFX may use this information to help improve the design of EFX Websites or EFX products, to communicate information to you, to enhance our marketing and research activities, and to facilitate other business functions.

What choices do I have about how EFX collects and uses personal information about me? You may always limit the amount and type of personal information EFX receives about you by not entering personal information into forms or data fields on EFX Websites. However, some of our online services may only be available to you if you provide certain personal information. Other parts of EFX Websites may ask whether you wish to opt out or opt in our contact lists to receive special offers, promotions and additional services that may be of interest to you.

You may also be provided with preference questions or preference boxes allowing you to indicate that you do not want EFX Websites to use tracking technologies, such as cookies, to 'remember' your personal information, such as user IDs or mailing addresses, on return visits. However, EFX Websites that use tracking technologies to collect unidentifiable information do not generally provide you with the ability to opt out of the tracking technologies. Who will have access to personal information about me? Personal information will only be accessible by a restricted number of EFX employees, certain companies with whom EFX may conduct joint programs, and/or by individuals and entities with whom EFX contracts to carry out certain business activities on EFX's behalf. We train our employees about the importance of privacy and how to appropriately handle, manage and secure customer data. EFX requires contractors who may have access to your personal information to not only secure such information but also to use such information only in the performance of its services on EFX's behalf. It is our intention to notify you when you register for any program conducted by EFX in conjunction with any another company that may require access to your personal information.

Does EFX share personal information with third parties? Unless it is necessary to provide access to your personal information in order to conduct a joint program or carry out a program or activity with a contractor, such as for credit card processing, EFX does not generally share your personal information with any third party and, whenever applicable, you will be provided with an opportunity to opt in or opt out of the program. In the event EFX sells one of its product lines or divisions, your personal information may be transferred to the buyer so that the buyer can continue to provide you with information and services. EFX requires contractors who may have access to your personal information to not only secure such information but also to use such information only in the performance of its services on EFX's behalf.

Notwithstanding anything contained herein to the contrary, EFX reserves the right to disclose your personal information to respond to authorized information requests from government authorities, to address national security situations, or when otherwise required by law.

How does EFX secure personal information? It is EFX's practice to secure each web page that collects personal information; however, the confidentiality of personal information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting any personal information over the Internet regardless the nature of the information. EFX cannot guarantee an unauthorized party will not gain access to your personal information; therefore, when submitting personal information to EFX Websites, you must weigh both the benefits and the risks. In addition, EFX Websites covered by this Privacy Policy will display a warning whenever you link to a website not controlled by EFX or not subject to this Privacy Policy. We recommend that you review the privacy policies of any such third-party websites before submitting personal information.

EFX has policies, which provide for the proper use and protection of social security numbers which may be obtained in the course of doing business with EFX. EFX's policy requires all social security numbers be appropriately secured to avoid loss, misuse or unauthorized access. Unlike this Privacy Policy, which applies only to online personal information, EFX's policies governing social security numbers apply to both online and offline collection and use of social security numbers.

How does EFX protect the privacy of children? EFX does not knowingly collect or use any personal information from children (for purposes of this Privacy Policy, "children" are defined as minors younger than thirteen (13) years of age) on EFX Websites. We do not knowingly allow children to order any EFX products, communicate with us, or use any of our online services. If you are a parent and become aware that your child has provided us with information, please contact us using one of the methods specified below, and we will work with you to address this issue.

How may I correct personal information or delete it from current customer records? You may request to remove your personal information from our current customer records or to amend your personal information. Please notify us of your wishes by contacting us in one of the ways specified below. For our record keeping purposes, we will retain certain personal information you submit in conjunction with commercial transactions.

In all communications to EFX, please include the email address used for registration (if applicable), the EFX Website URL or the specific EFX program to which you provided personal information (e.g. EFX.com, Humira.com, etc.), and a detailed explanation of your request. If you would like to delete or amend your personal information and are contacting us by email, please put 'Deletion Request' or 'Amendment Request', as applicable, in the subject line of the email. We will do our best to respond to all requests in a timely manner.

How will I know whether EFX has updated this policy? EFX reserves the right to amend this Privacy Policy without prior notice to reflect technological advancements, legal and regulatory changes and good business practices. If EFX changes its privacy practices, the revised Privacy Policy will posted and the effective date of the revised Privacy Policy will be set forth in this paragraph. This Privacy Policy was last updated on January 1st, 2011 and is effective as of that date.
